1. Scope
Scope of these general terms and conditions:
All deliveries and services that the Perlendesign VIDEJAMO online shop provides for you are carried out exclusively on the basis of the following General Terms and Conditions (GTC). Regulations that deviate from these General Terms and Conditions only apply if they are confirmed by us in writing. These terms and conditions apply exclusively to our private customers and our internet shop (www.perlendesign.co.at). Austrian law applies. The contract language is German. These terms and conditions also apply if individual clauses are declared invalid.

3. Offer and conclusion of contract
All offers are valid as long as stocks last". Exceptions exist if otherwise noted. Various errors excepted.
The presentation of the products does not constitute a legally binding offer, but rather an invitation to the customer to make a binding offer with the aim of concluding a contract with the Perlendesign VIDEJAMO company.
This offer from the customer is made to us by sending the items placed in the shopping cart. After receipt of the order placed by the potential customer in the online shop, the customer automatically receives a confirmation email documenting the offer (order) he has submitted.
This email simply confirms that we have received the order; However, this does not mean that a contract is concluded.
If it is not possible for the company Perlendesign VIDEJAMO to deliver an ordered product for various reasons such as empty stock, goods not 100% intact, errors in the stock quantity, the customer will be informed immediately and a product that is suitable for the customer and equivalent in terms of customer satisfaction will be contacted via personal contact Alternative offered. If a payment has already been made, the full amount paid will be refunded. An effective contract between the customer and us is only concluded when we accept the customer's offer by email or by delivering the goods.
An ordered item remains the property of Perlendesign VIDEJAMO until the amount to be paid is shown in our company account.

There are no additional shipping costs for download products.
Orderers outside the EU bear the costs of the money transfer themselves, i.e. all possible costs for bank transfer, customs, etc. must be borne in full by the buyer/orderer; There are usually no additional bank fees for euro transfers within the EU. All prices are stated by the company Perlendesign VIDEJAMO exclusively in euros.
Shipping costs will be invoiced separately at checkout.
Payment must be made in euros. We would also like to point out to customers that price changes are possible due to promotions, sales, collection changes, etc.

5. Delivery and shipping conditions
After the total amount has been credited to our account, we hand over the goods for shipping to the Austrian Post.
No guarantee is given for the availability of all items. When it comes to download articles, we strive to make them available permanently.
In the event of unavailability, the customer will be informed.
6. Right of withdrawal for consumers
A consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed to their commercial or self-employed professional activity.
Right of cancellation
You can revoke your contractual declaration within one month without giving reasons in text form (e.g. letter, email) or - if the item is left to you before the deadline - by returning the item. The period begins after receipt of this instruction in text form, but not before receipt of the goods by the recipient (in the case of recurring deliveries of similar goods, not before receipt of the first partial delivery) and also not before fulfillment of our information obligations in accordance with Article 246 § 2 in conjunction with § 1 Para 1 and 2 EGBGB as well as our obligations in accordance with Section 312g Paragraph 1 Sentence 1 BGB in conjunction with Article 246 § 3 EGBGB. To meet the cancellation deadline, it is sufficient to send the product(s) in a timely manner in appropriate packaging (protection against water or moisture, protection against breakage, etc.) to:

Consequences of revocation
In the event of an effective revocation, the services received by both parties must be returned and any benefits derived (e.g. interest) must be returned. If you are unable to return or return the received service and benefits (e.g. usage advantages) or only partially or only in a deteriorated condition, you must pay us compensation. You only have to pay compensation for the deterioration of the item and for any use made if the use or deterioration is due to handling of the item that goes beyond checking the properties and functionality. “Testing the properties and functionality” means testing and trying out the respective goods, as is possible and usual in a store.
Transportable items are to be returned at our risk. You have to bear the regular costs of returning the goods if the goods delivered correspond to those ordered and if the price of the item to be returned does not exceed an amount of 40 euros or, if the price of the item is higher, you have not yet received the consideration or one at the time of cancellation have made the contractually agreed partial payment. Otherwise, the return is free for you. Obligations to refund payments must be fulfilled within 30 days. The period begins for you when you send your cancellation declaration or the item, and for us when we receive it.
Exclusion of the right of withdrawal
The right of withdrawal does not apply, among other things, to contracts for the delivery of goods that are manufactured according to customer specifications or are clearly tailored to personal needs or that are not suitable for return due to their nature or that can spoil quickly or whose expiry date has been exceeded of audio or video recordings or of software and download items, provided that the data carriers delivered have been unsealed by the consumer, as well as for the delivery of newspapers, magazines and magazines (unless the customer has made his contractual declaration for the delivery of newspapers, magazines and magazines by telephone ).

If possible, please do not send the goods back to us freight forwarded, but rather as a prepaid package with a tracking number. We would also be happy to reimburse you for the postage costs in advance if we have to bear the return costs. Please avoid damage and contamination of the goods. If the original packaging is no longer available or is in a condition suitable for shipping, please ensure that the packaging is suitable to avoid damage during transport.
The above modalities are not a prerequisite for the effective exercise of the right of withdrawal.
7. Disclaimer
Perlendesign VIDEJAMO assumes no liability for damages that arise from or are related to the use of our goods. We expressly point out that some beads (e.g. some seed beads or pearls, threads or metal parts) have the possibility of discoloration - especially in connection with perfume, cream and sweat or strong sunlight, chlorinated water, detergents, chemical cleaning agents, etc. This does not represent a defect in the goods and is not a reason for a complaint! Various care instructions are also included in the product description.
All natural stones or freshwater pearls used are natural products and differ in color and shape. Various cracks, differences in color or differences in size do not constitute a defect and are not grounds for complaint.
Slight differences in color and size can occur despite careful production and do not give rise to complaints. The images of the items do not correspond to the original size. The image color may differ from the original.
8. Data protection and privacy
We will not pass on your personal data, including your home address and email address, to third parties without your express consent, which can be revoked at any time. Excluded from this are our service partners who require the transmission of data to process the order (e.g. the shipping company commissioned with the delivery and the credit institution commissioned with the payment processing). In these cases, however, the scope of the data transmitted is only limited to the necessary minimum.
9. Copyright
In particular, it is not permitted to copy, edit or publish images. Violations will be prosecuted under criminal and civil law.
Warranty
The provisions of statutory liability for defects apply.
If the customer acts as an entrepreneur, the limitation period for new goods is one year. If the seller has the choice of supplementary performance, the rights and claims due to defects are excluded for used goods. The statute of limitations does not begin again if the seller makes an appropriate replacement delivery within the scope of liability for defects.
The customer is advised that there is no warranty claim if the product had the specified and agreed quality at the time of transfer of risk.
There is no warranty claim if:

Damage caused or caused by the customer through misuse or improper use,

Damage caused by external influences such as extremely high or low temperatures, moisture, fire, unusual physical or chemical stress and incorrect storage.
If the customer acts as a consumer, he is asked to immediately complain to the deliverer about the delivered goods with obvious transport damage and to inform the manufacturer immediately.
Perlendesign VIDEJAMO also provides no warranty for damage or errors caused by improper repairs by third-party companies.
The authors are liable for defects in the item that are proven at the time of delivery or provision, but not for consequential damage.
Data Protection
The personal data provided to us by the customer as part of the business relationship, such as name, address, email, telephone number and delivery address, are stored and processed by us. We use the data within the scope of the legal authorization to carry out the order. By activating the box for data protection consent, the customer expressly agrees that the personal data provided by him when concluding the contract (such as name, address, e-mail, telephone number and delivery address) can also be used for his own marketing purposes and therefore in particular for mailings stored and processed for advertising purposes via SMS and email in accordance with Section 107 TKG. Personal data will not be passed on to third parties beyond this. Both consents can be revoked - even separately - at any time (e.g. by email to office.perlendesign@gmail.com). Within the framework of the legal provisions of §10 DSG 2000, our company makes use of the option of a service provider who is committed to complying with its obligations in accordance with §11 DSG. Neither our company nor our partners (service providers) transmit or provide data to recipients who are based outside the European Economic Area. We are obliged to comply with data security measures (§14 DSG) and data secrecy (§15 DSG).
The customer is obliged to inform us immediately of any changes to his residential or business address and contact details during the ongoing business relationship. If he fails to provide notification, declarations are deemed to have been received even if they are sent to the last address he provided.
